1. General rules:
1.1 This Agreement shall be binding on both parties and shall govern the rights, obligations, purchase and payment terms, delivery and return of goods, liability of the parties and other terms relating to the purchase and sale of goods from Coffee Guru Latvia Ltd (hereinafter referred to as the “Seller”) by the Buyer and the Seller.
1.2 The Buyer agrees to the terms of this Agreement by confirming this at the time of placing an order in the Online Shop or registering in the Online Shop.
1.3 The Seller shall have the right to change the terms of the Contract taking into account the requirements of the law. The Buyer shall be informed of this via the online shop or by e-mail.
2. Buying/Selling:
2.1 The agreement to buy/sell is concluded at the time when the customer:
2.1.1. confirm the purchase in the online shop (which shall be notified to the Customer by e-mail);
2.1.2. confirm their order by telephone, stating their delivery address, name and surname and sign the courier document (delivery note, electronically signed at the terminal or otherwise, depending on the courier’s requirements) upon receipt;
3. Rights and Obligations of the Purchaser:
3.1 The Buyer shall pay for the Goods in accordance with the Payment Terms.
3.2 The Buyer undertakes to comply with these conditions, which are described in the online shop and the legislation of the Republic of Latvia.
3.3 If the Buyer fails to fulfil its obligations, the Seller shall be entitled to immediately and without prior notice, limit or terminate its cooperation with the Buyer.
4. Seller’s rights and obligations:
4.1 The Seller shall have the right to cancel the Buyer’s order if the Seller is unable to contact the Buyer within 3 (three) working days after the Buyer has provided the contact details.
4.2 The Seller undertakes to respect the Buyer’s right to data privacy under the legislation of the Republic of Latvia.
4.3 If the Seller is unable to fulfil the Buyer’s order (to deliver the goods within the specified time and/or to deliver the goods exactly as ordered by the Buyer, then the Buyer shall have the right to return/refuse that order and the Seller shall refund the Buyer within 3 (three) working days if the Buyer has already settled the order with the Seller. An exception to this is if the Buyer and the Seller have mutually agreed on a different delivery time or an exchange of the goods for another.
5. Return of goods:
5.1 The Customer is entitled to return the goods within 14 (fourteen) days subject to the following conditions:
5.1.1. by informing the Seller of this decision by submitting a written application to the Seller;
5.1.2. by delivering the goods to the “Coffee Guru Latvia” Ltd. store – Kurzemes prospekt 1A, Riga, LV-1067 (T/C DAMME);
5.1.3. by delivering the goods in their original packaging, in the same condition as when purchased.
5.2 The Seller’s obligations include returning 100% of the goods to the Buyer within 30 (thirty) days to the bank account specified by the Buyer (in the application for return of the goods), less delivery costs, if any. The Seller shall be entitled to refuse the return of the Goods if the Goods are damaged and/or have been misused.
6. Delivery and payment terms
6.1 Delivery of orders is possible except on the spot at the “Coffee Guru Latvia” Ltd. store in Kurzemes prospekt 1A, Riga, LV-1067 at no additional charge or by courier throughout Latvia.
6.2 If delivery is requested before 14:00, the goods will be delivered by courier the next working day. For orders placed after 15:00, delivery shall be made on the next working day.
6.3 Payment for your order can be made in cash at the shop, by bank transfer, by payment of the prepaid invoice received or by credit card or automatic online banking payment.
6.4 The original of the delivery note shall be delivered to the Buyer together with the goods ordered.
6.5 The Parties agree to settle any disputes or differences, if any, arising after the approval of this Agreement by negotiation. If any disputes arising cannot be settled by negotiation, they shall be referred to the Riga Court of Arbitration.
7. Warranty
7.1 If you change your mind and decide to withdraw from the purchase, the Consumer Rights Protection Law of the Republic of Latvia (CPRL) and the regulating Cabinet of Ministers Regulation No.255 “Regulations on Distance Contract” (Cabinet Regulation No.255) state that the buyer has the right to withdraw from the contract within 14 calendar days and return the goods purchased in the online shop to the seller. Article 12(6) of the RTS provides that, in the case of a distance contract, “the consumer shall be responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal”. We recommend that you keep the original packaging of the goods so that the goods are not mechanically damaged externally when exercising the right of withdrawal under the terms of the Distance Contract. Coffee Guru Latvia Ltd reserves the right to refuse to accept goods which are damaged or not fully complete. 7.2 If during the use of the goods the goods have technical problems, the goods will be serviced in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (CPRL). The service period of the goods is specified in the description of the goods. Purchase documents are valid only if they correctly and clearly indicate: the model, serial number, date of sale. It is forbidden to make any changes, deletions or overwriting of the data in the purchase documents, in which case the service documents will be considered null and void.
7.3.Claims received regarding the quality of the goods shall be settled in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (CRPL), in accordance with the requirements of the Cabinet of Ministers Regulation No.631 “Procedure for filing and settlement of consumer claims for goods or services that do not comply with the terms of the contract” (Cabinet Regulation No.631).
7.4 Please note that the provisions of the RTS do not apply to the purchase of goods by legal persons.
